UModelVerse Privacy Policy

To facilitate your registration, login, and use of related services, and to provide you with a more personalized user experience and services, we may collect and use your relevant information when you use UModelVerse. UModelVerse attaches great importance to the protection of user information. We will take security protection measures in accordance with laws and regulations to ensure the security and controllability of your information. In this regard, UModelVerse has formulated this UModelVerse Privacy Policy (hereinafter referred to as “this Statement and Policy”) and reminds you: please be sure to carefully read this Statement and Policy before using the services provided by UModelVerse. Only after fully understanding and agreeing to it should you proceed. Once you start using UModelVerse, it is deemed that you have fully read, understood, and accepted this Statement and Policy, which will then have legal effect between you and UModelVerse.

Definitions

  • UModelVerse Model Service Platform: Refers to the UModelVerse model service platform under UCloud (hereinafter referred to as “UModelVerse” or “we”).
  • UCloud: Unless otherwise specified, refers to UCloud Technology Co., Ltd. (“UCloud”).
  • UCloud Cloud Service Users: Users who complete the account registration process on the UCloud cloud service website (referred to as “users” or “you”).
  • User Information: Refers to information submitted by you when registering a UCloud cloud service website account, undergoing real-name authentication, using UCloud services, or collected by UCloud to provide services to you, such as name, identity document information, organization name, contact details, communication address, etc.
  • Business Data: Different from user information, refers to the content stored on UCloud cloud servers due to your use of UModelVerse, including but not limited to data, text, audio, video, or images.

I. Ownership of Rights

1.1 Logo, “UCloud”, “UModelVerse” and other words, graphics and their combinations used in the UModelVerse model service platform to identify UCloud cloud services are registered trademarks of UModelVerse Technology Co. Without UCloud’s written authorization, no one is allowed to display, use or otherwise deal with them in any way (including but not limited to copying, distributing, displaying, mirroring, uploading, downloading), or indicate to others that you have the right to display, use or otherwise deal with them.

1.2 The intellectual property rights in all products, services, technologies and programs of the UModelVerse Model Services Platform (“Technology Services”) belong to UCloud or its right holders.

II. Limitation of Liability

2.1 UModelVerse users upload, provide and publish relevant information on UModelVerse by themselves, including but not limited to user’s name, company name, contact person and contact information, relevant pictures, information, etc. Such information is provided by the users by themselves, and the UModelVerse users shall be fully responsible for any information provided by them according to the law.

2.2 UModelVerse reproduces the works on UModelVerse only for the purpose of transmitting more information, and does not imply that UModelVerse endorses its views or confirms the authenticity of its content.

2.3 UModelVerse hereby reminds you that you should comply with the legal requirements during your use of UModelVerse, and should not jeopardize network security or use UModelVerse’s services to engage in activities that infringe upon the reputation, privacy, intellectual property rights and other legitimate rights and interests of others. Notwithstanding the foregoing, UModelVerse does not assume any responsibility for the use and purpose of your use of UModelVerse.

III. Intellectual Property Protection

We respect intellectual property rights and oppose and fight against infringement of intellectual property rights. Any organization or individual who believes that the contents of the web pages of UModelVerse’s website may infringe on his/her legitimate rights and interests may submit a written notice of rights to UModelVerse, which will be dealt with as soon as possible according to the law upon receipt of the notification confirmed by the owner of the intellectual property rights.

Privacy Policy

UModelVerse respects and protects user information and will treat such information with a high degree of diligence and discretion. When you use the services provided by UModelVerse, we will collect, process and disclose your information in accordance with this Privacy Policy. This policy will help you understand the following:

1. Scope of Application

1.1 This Privacy Policy applies to all UModelVerse Services. The Services include page views, website login services provided to you, and technical services provided to you through UModelVerse or by UModelVerse technicians through unofficial channels.

1.2 Our Services may contain links to third party websites, applications or services, and this Privacy Policy does not apply to any products, services, websites or content provided by third parties.

1.3 It should be noted in particular that, as a user of UModelVerse, if you utilize the UModelVerse Services to provide further services to your users, you should separately agree on a privacy policy with your users as your business data belongs to you.

2. Collection and Use of User Information

2.1 Collection of User Information

2.1.1 When you create an account with UCloud, you are required to provide us with a registered email address to set and confirm your login password. The registered email address you provide is your cloud service account, and the cell phone number you submit is used to accept the verification code when you register, log in, bind your account, and recover your password, and as one of the contact information designated by you and UCloud to receive relevant business notifications (e.g., new products on line, changes in services, etc.), and UCloud may send you business notifications (including bills), publicize products, marketing promotions, or communicate with you through this contact information. UCloud may use this contact method to send you business notices (including billing), promote products, marketing promotions or communicate with you.

2.1.2 Before accepting the domain name, filing and other services, according to the laws of the People’s Republic of China, UCloud will show you the information you need to submit through the page of UCloud website (including, but not limited to, the name of the person in charge of your business or website, ID card, cell phone number, mailbox, domain name certificate, filing photographs, etc.), subject to the display of the page of the website at the time, and if you don’t use some of the services, you don’t need to provide the relevant information. If you do not use certain services, you do not need to provide relevant information.

2.1.3 In the course of your use of the Services, we will receive and record the information related to the equipment you use (e.g., equipment model, operating system version, equipment settings, unique equipment identifier and other hardware and software characteristics), the location of the equipment (e.g., IP address, GPS location, and Wi-Fi access points, Bluetooth and base stations capable of providing the relevant information), and the location of the equipment (e.g., IP address, GPS location, and Wi-Fi access points, Bluetooth and base stations capable of providing the relevant information), based on the specific privileges granted by you in the software installation and usage. access points, sensors such as Bluetooth and base stations, etc.). 2.1.4 When you use the services offered on our website, we automatically collect details of your usage of our services, which are kept as relevant web logs. 2.1.5 Please note that separate device information, log information, etc. is not information that can identify a specific natural person. If we combine such non-personal information with other information for the purpose of identifying a specific natural person or use it in combination with personal information, such non-personal information will be regarded as personal information during the period of combination, and we will anonymize and de-identify such personal information unless we have obtained your authorization or as otherwise stipulated by laws and regulations.

2.1.6 Based on your use of UModelVerse, we will record and analyze your inquiries, trouble reports and troubleshooting processes (such as communication or call logs), so that we can respond to your requests for assistance in a more timely manner and improve our services.

2.2 We Use Your Information for the Following Purposes:

2.2.1 In order to provide you with products or services (e.g., real-name authentication information, cell phone numbers used to receive verification codes are a prerequisite for continued access to services);

2.2.2 In order to maintain and improve the products or services (e.g., the business contact’s cell phone and email you submit for receiving business notifications and business communication);

2.2.3 We may design, develop, and promote new products and services based on statistical data of user information; we may keep statistics on the use of our services and may share such statistical information with the public or third parties, but such statistical information does not contain any of your identifying information

2.2.4 To promote and introduce products to you as permitted by laws and regulations;

2.2.5 To improve the security of your use of the services provided by us and our affiliates and partners, to protect your personal and property safety or that of other users or the public from infringement, to better prevent phishing websites, fraud, network vulnerabilities, computer viruses, network attacks, network intrusion and other security risks, and to more accurately identify violations of laws and regulations or UModelVerse related agreements and rules. 2.2.5 We may use your account information, and integrate device information, relevant network logs, and information shared by our affiliates and partners to determine the risk of your account and transactions, authentication, detection and prevention of security events, and to take the necessary recording, auditing, analyzing, and disposal measures in accordance with the law;

2.2.6 Other uses with your permission.

3.1 We may collect and use information about you through cookies and other related technologies. The specific purposes for which we use cookies include:

3.1.1 To remember who you are. For example, cookies help us to recognize you as our registered user.

3.1.2 To analyze your use of our services in order to provide you with more thoughtful and personalized services, including but not limited to customized pages, recommendations, and so on.

3.2 You can refuse or manage cookies through your browser settings, but please note that if cookies are deactivated, you may not be able to enjoy a quality service experience, and the availability of certain features may be affected.

3.3 We will not use cookies for any purpose other than those stated in this statement and policy.

4. Sharing, Transfer, and Public Disclosure of User Information

4.1 Sharing

We will not share your User Information with other organizations and individuals except under the following circumstances:

4.1.1 We will share your user information with other parties after obtaining your explicit consent;

4.1.2 We may share your user information externally in accordance with the provisions of laws and regulations, litigation, arbitration settlement needs, or as required by administrative or judicial authorities in accordance with the law;

4.1.3 We may entrust trusted partners to provide services, so we may share some of your user information with our partners to provide better customer service and optimize user experience. We will only share your User Information for lawful, legitimate, necessary, specific, and explicit purposes, and will only share User Information that is necessary to provide the Services. Our partners are not authorized to use the shared user information for any other purpose. Currently, we have the following types of authorized partners: vendors, service providers, and other partners. We send information to vendors, service providers and other partners who support our business by providing user authentication services, basic technical services, providing consulting, analytics and other professional services. Companies, organizations and individuals with whom we share user information are bound by strict confidentiality agreements or by confidentiality clauses that require them to handle user information in accordance with our instructions, this Privacy Policy and any other relevant confidentiality and security measures.

4.2 Transfer

We will not transfer your User Information to any company, organization or individual, except as follows:

4.2.1 We will transfer your user information to other parties after obtaining your express consent;

4.2.2 In the event of a merger, acquisition or bankruptcy liquidation situation between UCloud and another legal entity, or other situations involving mergers, acquisitions or bankruptcy liquidation, if it involves the transfer of user information, we will require the new company or organization holding your user information to continue to be subject to this policy, or we will require the company, organization and individual to seek authorization from you again for consent.

4.3 Public Disclosure

We will publicly disclose your User Information only under the following circumstances:

4.3.1 With your express consent or based on your active choice, we may publicly disclose your User Information;

4.3.2 In order to protect the personal and property safety of users of UModelVerse and its affiliates or the public from infringement, we may disclose User Information about you in accordance with applicable laws or relevant agreements and rules of the UCloud Cloud Platform.

In the following cases, sharing, transferring, or publicly disclosing your user information does not require your prior authorized consent:

4.4.1 Those related to national security, national defense security;

4.4.2 Related to public safety, public health, and significant public interests;

4.4.3 Related to crime investigation, prosecution, trial and judgment execution;

4.4.4 For the purpose of safeguarding the life, property and other significant legal rights and interests of you or other individuals, but it is difficult to obtain my consent;

4.4.5 Personal information that you disclose to the public on your own;

4.4.6 Related to the fulfillment of your obligations under laws and regulations;

4.4.7 Personal information collected from legitimate publicly disclosed information, such as legitimate news reports, government information disclosure and other channels.

5. Business Data

5.1 The business data that you analyze, process, store, upload, download, distribute and otherwise deal with in the course of using UModelVerse are your User Business Data and you fully own your User Business Data.UCloud, as a cloud service provider, will only deal with your business data in strict accordance with your instructions, and will not make any unauthorized use or disclosure of your business data, except in accordance with the requirements of laws and regulations agreed upon or enforced by you. UCloud, as a cloud service provider, will only process your business data in strict accordance with your instructions and will not make any unauthorized use or disclosure of your business data except in accordance with consensus with you or the implementation of explicit legal and regulatory requirements.

5.2 UModelVerse reminds you to be careful in judging the legality of the source and content of the User Business Data: you should ensure that the User Business Data is collected and used in accordance with the law (including, but not limited to, entrusted processing, etc.), and that you will not, and have not, infringed upon the legal rights of any individual or entity in any way. You understand and agree that China and other countries and regions may have relevant regulations on data storage and exit, etc. Before you use UModelVerse to store and transmit user business data, you should follow the applicable laws and regulations of the relevant regions to conduct full and necessary evaluation and approval to ensure compliance with the relevant regulations, otherwise you will bear all the results and responsibilities. You shall bear all the results and responsibilities caused by the violation of laws and regulations, departmental rules or national policies with respect to the source, content or processing of your user business data.

5.3 According to the consensus between you and UModelVerse, we store user business data in the data center selected by you.UCloud protects user data stored in UCloud cloud data centers in accordance with applicable laws and regulations, except for the loss of data due to your failure to comply with relevant laws and regulations, or the deletion of resources in arrears or resources that have expired.

6. Management of User Information

6.1 You can access, modify and delete your user information. In order to protect your account security, legitimate rights and interests, different information may have different requirements for accessing, modifying and deleting, and some of your information may not be accessed, modified and deleted based on technological logic, legal and regulatory requirements, protection of information security and other justifiable reasons (e.g., you may not be able to change the assigned account ID).

6.2 In the following cases, you may make a request to us to delete user information:

6.2.1 If our handling of User Information violates laws and regulations;

6.2.2 If we collect or use your User Information without your explicit consent;

6.2.3 if our processing of personal information is in serious breach of our agreement with you; we may ask you to verify your identity (you may need to provide a written request or otherwise prove your identity) before processing your request.

6.3 You may cancel your previously registered account [see Cancellation of Account], after successful cancellation, we will stop providing you with products or services, and all services and data under the account will be deleted and cannot be recovered. In addition, we will delete or anonymize your personal information at your request, except as otherwise provided by laws and regulations.

7. Security of User Information

7.1 UModelVerse takes the security of your information very seriously. We endeavor to take all reasonable physical, electronic and managerial security measures to protect your User Information. We protect User Information from unauthorized access, public disclosure, use, modification, damage or loss. We use encryption technology to improve the security of User Information; we use trusted protection mechanisms to prevent malicious attacks on User Information; and we deploy access control mechanisms to try to ensure that only authorized personnel have access to User Information.

7.2 We will take reasonably practicable steps to avoid collecting irrelevant User Information. We will only retain your User Information for as long as is necessary to fulfill the purposes set out in this Policy, unless we need to extend the retention period or are permitted by law to do so. We will delete or anonymize your personal information beyond the retention period described above.

7.3 Please help us to keep your account secure by using complex passwords. We will endeavor to keep any information you send us secure. We will be liable for any breach of our physical, technical or administrative safeguards that results in unauthorized access, public disclosure, alteration or destruction of information, resulting in damage to your legal rights and interests.

7.4 Please understand that, due to technical limitations and the possible existence of a variety of malicious means, in the Internet environment, even if every effort is made to strengthen security measures, it is not always possible to ensure that the information is 100% secure. You should be aware that the systems and communication networks you use to access our services may be subject to problems due to factors beyond our control. In the unfortunate event of user information security incident (leakage, loss, etc.), we will, in accordance with the requirements of laws and regulations, promptly inform you of: the basic situation of the security incident and the possible impact, the measures we have taken or will take to deal with the situation, the suggestions you can independently prevent and reduce the risk, and remedial measures for you. We will promptly inform you of the event-related situation by email, letter, phone call, push notification, etc. When it is difficult to inform the users of the subject of the information one by one, we will take a reasonable and effective way to issue a public announcement.

7.5 At the same time, we will also report the disposition of user information security incidents in accordance with the requirements of the regulatory authorities.

7.6 We will store your user information collected in mainland China in accordance with relevant laws and regulations. If we need to transmit user information out of the country due to business needs in compliance with applicable laws and regulations, we will obtain your consent in advance and inform you of the purpose of the user information going out of the country, the recipients, the security measures, the security risks and other circumstances.

7.7 In the event that the UModelVerse Service ceases to operate, we will take reasonable measures to protect the security of your user information, including promptly stopping activities that continue to collect user information; notifying users of the cessation of the operation in the form of one-by-one delivery or public announcement; and deleting or anonymizing personal information in our possession.

8. Protection of Minors’ Information

8.1 We offer our products and services primarily to adults. Minors under the age of 14 are not permitted to create their own user accounts without the consent of a parent or guardian.

8.2 If you are over the age of 14, we will ask you to ask your parent or guardian to read this Privacy Policy carefully and to use our services or provide information to us with the consent of your parent or guardian.

8.3 In the event that we collect personal information from minors with the consent of their parents or guardians to use our products or services, we will only use, share, transfer or disclose this information as permitted by law or regulation, with the express consent of the parents or guardians, or as necessary to protect the minors.

9. Your Rights

In accordance with relevant international laws, regulations and standards, as well as common practices in other countries and regions, we guarantee you the exercise of the following rights with respect to your personal information:

9.1 You have the right to access your User Information by logging into your account with UModelVerse, except for the exceptions stipulated by laws and regulations. If you are unable to access your User Information properly, you may send an e-mail to usupport@ucloud.cn and we will respond to your access request within 30 days. We will provide you with additional User Information that you generate in the course of using our products or services, to the extent that it is technically feasible and cost effective to do so.

9.2 Correction of your User Information You have the right to ask us to correct your User Information that we have processed if you find it to be incorrect. You can do this by sending an e-mail to usupport@ucloud.cn We will respond to your request for correction within 30 days.

9.3 Changing the Scope of Your Authorized Consent Every business function requires some basic user information in order to be completed. You may give or withdraw your consent at any time for the collection and use of User Information that exceeds business requirements. When you withdraw your consent, we will no longer process the corresponding user information. However, your decision to withdraw your consent will not affect the processing of User Information previously carried out on the basis of your authorization.

9.4 Responding to your request above For security purposes, you may be required to provide a written request or otherwise prove your identity. We may ask you to verify your identity before processing your request. We will respond within thirty days. In principle, we do not charge a fee for your reasonable requests, but for requests that are repeated multiple times and exceed reasonable limits, we will charge a fee for certain costs, as appropriate. We may deny requests that are unnecessarily repetitive, require excessive technical means (e.g., requiring the development of a new system or a fundamental change in existing practices), pose a risk to the legal rights of others, or are highly impractical (e.g., involving the backing up of information stored on magnetic tapes).

10. Updates to the Statement and Privacy Policy

We may revise the terms of the Legal Notice and Privacy Policy from time to time, and such revisions form part of this Statement and Policy. If there is a change in an important rule that may materially reduce your rights under this Statement and Policy or expand the scope of information we collect or use, we will notify you by prominently displaying it on the UCloud website or by sending you an email or otherwise notifying you of the change before it becomes effective. In such cases, by continuing to use our services, you agree to be bound by this Statement and Policy as amended.
