Welcome to SurferCloud. These Terms of Service (the "Agreement") govern your use of all services provided by SurferCloud (the "Services"). By registering, accessing, or using our Services in any way, you acknowledge that you have read, understood, and agree to be bound by all the terms of this Agreement. If you do not agree with any part of this Agreement, you must immediately stop using our Services.
2.1 Account Information
You agree to provide true, accurate, complete, and up-to-date personal and contact information during registration. You are responsible for keeping this information current. Providing false or inaccurate information may lead to the termination of your account.
2.2 Account Security
You will choose an account name and password. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use or security breaches you become aware of.
2.3 Account Conduct
You are responsible for all activities conducted under your account. You must ensure that your website and content comply with all applicable laws and regulations.
2.4 Account Ownership
For security purposes, SurferCloud does not permit account transfers. We reserve the right to immediately terminate any account that is found to have been transferred or sold, with no refund provided.
3.1 Service Term
The service term begins on the date of your successful order and payment, and the specific duration is selected by you at the time of purchase. Unless terminated under this Agreement, the service will automatically renew for a continuous period equal to the initial term.
3.2 SurferCloud's Right to Terminate
We reserve the right to terminate this Agreement at any time for any or no reason. In such cases, we will provide you with written notice two (2) days prior to the service interruption. Written notice includes, but is not limited to: email, Telegram, WhatsApp, and messages within the client portal.
3.3 Termination for Violation
If you or your end-users violate any of the terms of this Agreement, SurferCloud may terminate your Services immediately without prior notice. In this event, all fees paid will be forfeited and are non-refundable.
3.4 Data Handling
Upon termination of the Agreement, you are solely responsible for migrating all of your data. SurferCloud is not responsible for retaining or backing up any of your data. We highly recommend that you complete all data backups before terminating your service.
As a general principle, we do not support refunds, as we offer a free trial opportunity to users (which can be activated by contacting our support team). In special circumstances where you need to request a refund or a withdrawal of your account balance, please follow these steps:
5.1 Service Changes
We reserve the right to modify service content and resource allocations at any time without prior notice.
5.2 Pricing Changes
The price you pay for your current service term will not increase. However, SurferCloud reserves the right to change the prices listed on our website at any time. Price adjustments will not affect your current paid service term, but the new pricing may apply upon renewal.
You agree that your use of SurferCloud's Services is at your own risk and that you are solely responsible for backing up all your data. SurferCloud is not liable for any data loss.
7.1 No Warranties
SurferCloud Services are provided on an "as is" and "as available" basis. We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free.
7.2 Limitation of Liability
In no event shall SurferCloud be liable to you for any direct, indirect, incidental, special, or punitive damages resulting from your use of the Services, including but not limited to loss of profits, data loss, or business interruption.
SurferCloud respects the intellectual property rights of others and requires our users to do the same. All content you upload to our servers remains your property. However, you grant us a non-exclusive, worldwide, royalty-free license to use your content as necessary to fulfill our obligations under this Agreement.
Your privacy is important to us. Please refer to our Privacy Policy to understand how we collect, use, and protect your personal information. The Privacy Policy is an integral part of this Agreement.
